Overview

A partner or family visa lets you stay permanently in Australia if you are a partner, de facto partner, parent, or child of an Australian Citizen or an eligible permanent resident. There are different subclasses for onshore and for offshore applicants. Please look into the following categories for more information.

Partner visa

This visa allows you to come to Australia and live permanently if you are married to an Australian citizen or permanent resident or, if you are in a de facto relationship with an Australian citizen or a permanent resident. An onshore applicant is required to Apply for SC 820 and 801 together and offshore applicant is required to apply for SC 309 and 100 together.

Once a temporary visa is granted, it is valid for the whole waiting period until the Australian government comes to a decision on your permanent visa SC 801 or SC 100. Getting a temporary partner visa is the first step toward the permanent residency visa. The processing time for SC 820 and SC 801 is 5 to 39 months and for SC 309 and 100 is 6 to 36 months respectively.

The application for both the visas will cost you AUD 8,085 each as you will not need to pay for the permanent visa application separately. You will need to be sponsored by your partner. Generally, you will need to meet the relationship requirement along with health and character requirements. If you are applying as a de facto partner, you must have been in a relationship for a minimum of 12 months.

You may also be eligible to apply for a prospective marriage visa SC 300 if you are yet to marry your partner. It allows you to travel to Australia and marry your partner. You will be granted this visa for 9 to 15 months. Generally, you will need to be over 28 years of your age. You must be outside Australia when you make an application for this visa. You must be sponsored by your prospective partner to be able to apply for this visa. A visa application for SC 300 will cost you AUD 8,085 and the application will be processed between 8 to 35 months. With this visa, you will need to comply with conditions 8502, 8515, 8519, and 8520. You must abide by all these conditions during your stay in Australia.

Parent visa

This visa lets a parent of a settled Australian citizen or Australian permanent resident move to Australia. This includes both permanent visa SC 103 and temporary visa SC 870. The temporary visa SC 870 can be granted for up to 3 or 5 years. To be eligible, you must show that your child is settled permanently in Australia.

SC 103

This visa lets you move to Australia permanently. To be able to get this visa, you must be a parent of an Australian citizen or a permanent resident. You must be sponsored by your child to move to Australia permanently. However, you will not need to be sponsored by your child if you apply as a retiree. You must meet the balance-of-family test, which requires at least half of your eligible children and stepchildren to be living in Australia, than in any other single country. You will need to obtain an assurance of support as it assures the government that you will not have to rely on government assistance after you enter Australia on this visa. You will not need an Assurance of Support (AOS) application if you apply as a retiree. You must not have already applied for or hold an SC 870 visa. You must meet the health and character requirements. The processing time is not fixed. As of Jan 2022, visas queued up to Oct 2010 have been released for final processing. A visa application for this visa will cost AUD 6,65. Under this visa you must comply with conditions 8515 and 8502.

SC 870

This visa lets you move to Australia temporarily. To be able to get this visa, you must be a parent of an Australian citizen or a permanent Australian resident. You must have sponsorship approval from your child to move to Australia temporarily. You must lodge your visa within 6 months of the sponsorship approval. An onshore applicant can apply for “Permission to apply in Australia”. You will need to apply for the visa within 60 days if you are given permission to apply in Australia. You must meet the health and character requirements. The processing time for this visa is between 73 days to 9 months. A visa application for this visa will cost AUD 5,090 for up to 3 years stay and AUD 10,180 for up to 5 years stay. Under this visa, you must comply with conditions 8013, 8303, 8501, 8531, 8550, 8564, and 8609. You might also be eligible for a contributory parent visa or an aged parent visa.
